ReCharge Band Contest Terms and Conditions

ReCharge Music (ABN 92 540 410 903) which includes its related bodies corporate and all of their contractors and partners (“Producer”) is inviting applications from independent music ensembles (“Band”) who may be interested in participating in the music competition, ReCharge Band Contest) (“Contest”).

In return for the Producer considering your application, you, the person making this application, have been authorised by all members of the Band to agree on their behalf to these Terms and Conditions and represent, warrant and undertake that all of the information and answers you provide are true and correct to the best of your belief.

I. Introduction

These Terms and Conditions apply to all ReCharge Band Contest contestants. The Producer may amend them from time to time.


Entry and participation in the Contest shall be deemed an unconditional acceptance by the Band of these Terms. All entry instructions and any other specific details relating to the

Contest or the prizes form part of these Terms.

You must pass a copy of these Terms and Conditions to each member of the Band and ensure they comply with them. By entering the Contest entrants will be deemed to have read and understood these rules and be bound by them.

II. Eligibility

The Contest is open to Bands consisting of all nationalities and countries.

Only Bands who are not signed to a major label record company and/or its affiliates or subsidiaries are eligible to apply for the Contest. By submitting an application form, the Band acknowledges that they are not signed to a label record company and/or its affiliates or subsidiaries. 


All members of the Band must be 18 years of age or older on 1 July 2023.

III. How to Apply

To apply for the Contest participants must submit materials required on the web page of the Contest. It is the entrant’s responsibility to ensure that the submitted materials are complete and playable.

If you are applying on behalf of multiple Bands, each entry will be considered as a separate entry. For each entry, the separate application form must be completed online.

No changes of details are allowed after the application is submitted.

Entries must be received no later than the submission Deadline, listed on the website.

The Contest is not responsible for late, misdirected, incomplete, or misappropriated entries.

Neither the Contest staff nor the panel of judges associated with the Contest gives any feedback or critique to entrants except for the Winners. No communication or correspondence is guaranteed to be exchanged with participants except with those selected as Winners.

IV. Repertoire Req

The repertoire requirements are specified on the respective Contest web page.

Music, songs, costumes or any visual content that are not considered appropriate for performance due to content, by the Producer or panel of judges, will be disqualified.

V. Contest Results

Contest results will be published on the respective Contest web page on the date specified on the respective Contest web page.

The monetary prize may be awarded by the Contest based on the majority vote of the judges. The Competition reserves the right to overrule the judges' decision and/or do not award the monetary prize entirely. In the case of multiple prize recipients, the advertised prize will be shared among the recipients. The prize will be sent electronically to the winner(s) after all the results are announced.

VI. Winners Who Perform at the ReCharge Music Fest

Winners of the Contest who are awarded a performance (Performing Bands) at the ReCharge Music Fest (“Fest”) will perform one piece or more selected by the judges from the Band’s audition repertoire. The performance time limit is stated on the Contest’s web page.

Performing Bands must provide additional materials if and when requested by the Fest, including but not limited to names of members of the Band, photographs, logos of the Band, if applicable.

Performing Bands must prepare their own instruments for their performance. If members of a Performing Band for the performance are different from members who appeared in the submission material, the Band may not be allowed onto the stage.


Performing Bands must successfully perform at the Fest to be eligible to receive their prizes.

All participants are responsible for their own expenses related to the Fest participation, their travel to and from the Fest as well as but not limited to their own safety, health, and well-being before, during, and after the Fest.

VII. The Producer Is Not Liable:

The Producer, its owners and employees, and the Contest shall have no liability to any cost incurred for the production and submission of materials required by the Contest.

The Producer, its owners and employees, and the Contest shall have no liability to Performing Bands for any delay or annoyance caused to Performing Bands arising out of the actions of any public authority or on account of any strike, lockout or other labor difficulties, and the Producer, its owners and employees, and the Contest shall not be responsible or have any liability for loss or damage to the equipment or personal properties of Performing Bands or of any officer, agent, employee, performer or independent contractor of Performing Bands kept or placed in the premises or the building of the performance venue, or used in connection with any rehearsal, performance or engagement to be given or entrusted to any person employed at the performance venue or by the Contest, whether due to fire, theft or any other cause. The Producer, its owners and employees, and the Competition shall not be liable in any way because of the Contest’s inability to provide heating or air-conditioning of the venue. Further, Performing Bands hereby recognises and acknowledges that (a) there is an inherent risk of exposure to Infectious Disease in any public place where people gather, particularly indoors and in group settings; (b) the performance of the Contest obligations entails the gathering of people in indoor and/or group settings; and (c) the Contest cannot completely manage or mitigate the risks associated with Infectious Disease. Participant assumes all known and unknown risks related to exposure to Infectious Disease. The Producer, its owners and employees, and the Contest shall not be liable, and Performing Bands shall not bring any claim or demand against the Producer, its owners and employees, and the Contest, for any injury, damage, loss, expense, or other liability related to Infectious Disease that may arise, directly or indirectly, in connection with the Performing Bands’ performance.

VIII. Limitation of Liability

The Producer and the Contest assume no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of audition materials. The Producer and the Contest is not responsible for any incorrect or inaccurate information, whether caused by website users, by any of the equipment or programming associated with or utilised in the Contest or by any technical or human error, which may occur in the administration of the Contest.

The Producer and the Contest assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, audition materials.

The Producer and the Contest are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing.

The Producer and the Contest are not responsible for any injury or damage to the entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any prize. The Producer and the Contest assume no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Producer and/or the Contest, such as infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of the Contest and/or the Contest Website.

There will be no transfer and substitution of awards, including cash awards, Prizes, Plaques, etc., except as necessary due to availability in which case a prize of equal or greater value will be awarded. All taxes, and customs fees, when applicable, are the sole responsibility of the Entrant and/or the Winner.

The Producer and the Contest is not responsible and will not pay any winners’ taxes or customs fees.

IX. Conduct

By participating in the Contest, each participant agrees to be bound by the current Terms and Conditions, as amended, which are posted on this page and on the Contest web pages. Participant further agrees to be bound by the decisions of the Contest, which shall be final and binding in all respects.

The Contest reserves the right, in its sole discretion, to disqualify any participant found to be: (a) violating the Contest Terms and Conditions and Competition Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest and/or the Contest Website; (c) violating the terms of service, conditions of use and/or these Terms and Conditions or guidelines of the Contest; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.

Winners must at all times behave appropriately when taking part in the Fest and observe the Competition Rules and any other Policies Rules or Regulations in force at the venue and/or other locations. The Contest reserves the right to remove from the venue or other premises or location, any Winner and/or a person (-s) accompanying the Winner who breaks such rules and/or fails to behave appropriately and to disqualify such Winner.

X. Privacy / Use of Personal Information

By participating in the Contest, an participant:

Grants the Producer and the Contest the right to use his/her/their name(s), mailing address(es), telephone number(s), and e-mail address(es) (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the Winner;

Grants the Producer and the Contest the right to use his/her/their Personal Information, including but not limited to the name of the participant(s) and his/her/their and accompanist(s), the program performed for the submission, the country of residence, the link to the video recording, place earned at the Contest, the instrument, other information provided by the participant, for publicity and promotional purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law.

Grants the Producer the right to contact the participant and his/her/their accompanist(s) for marketing purposes regarding products and services of the Producer.

XI. Intellectual Property

All intellectual property, including but not limited to trade- marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Producer and/or its affiliates. All rights are reserved.

Unauthorised copying or use of any copyrighted material or intellectual property without the express written consent of the Producer is strictly prohibited.

All participants release the right for the Producer and the Contest to use the program performed for the submission for publicity, promotional and commercial purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law.

All Performing Bands release the right for the Producer and the Contest to photograph, record, film, edit, digitise and publish the programs performed at the Fest for publicity, promotional and commercial purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law.

XII. Changes and Termination

The Producer reserves the right, in their sole discretion, to terminate the Contest, in whole or in part, and/or to modify, amend or suspend the Contest, and/or the Terms and Conditions in any way, at any time, for any reason without prior notice.

XIII. Law

These are the official Terms and Conditions of the Contest. The Terms and Conditions are subject to applicable Australian federal and State of New South Wales laws and regulations. The Terms and Conditions and Rules are subject to change without notice in order to comply with

any applicable Australian federal and State of New South Wales laws or the policy of any other entity having jurisdiction over the Producer. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations as between the participant and the Contest in connection with any contests of the Producers shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such determination shall in no way affect the validity or enforceability of any other provision herein.

XIV. Langauge Discrepancy

In the event of any discrepancy or inconsistency between the terms and conditions of these Terms and Conditions and disclosures or other statements contained in any Contest-related or Fest-related materials, including but not limited to the Contest submission form, TV, print or online advertising, the terms and conditions of these Terms and Conditions shall prevail, govern and control.

XV. Participant’s Representations

By entering the Contest, the band represents that he/she/they have read these Terms and Conditions and the Contest Rules and consent to the Terms and Conditions and Contest Rules.
